NUVORA TERMS OF SERVICE
Last updated: 24 July 2026
Brand name: NUVORA
Website: https://test-nuvora.myshopify.com
Country of operation: South Africa
These Terms of Service govern your access to and use of the NUVORA website and your purchase and use of NUVORA’s personalised reports, appearance recommendations, edited images, digital visualisations and related services.
By placing an order, submitting photographs or information, selecting an acceptance checkbox, accessing a deliverable or otherwise using the service, you confirm that you have read, understood and agreed to these Terms.
If you do not agree to these Terms, you must not purchase or use the service.
1. Definitions
In these Terms:
“NUVORA”, “we”, “us” or “our” means [insert full legal name], trading as NUVORA.
“you”, “client”, “customer” or “user” means the person who accesses the website, places an order, submits information or uses a deliverable.
“service” means NUVORA’s personalised appearance-analysis and guidance services, including reports, recommendations, digital content, image editing and visual examples.
“deliverable” means any report, recommendation document, checklist, edited image, visualisation, analysis or other digital output supplied by NUVORA.
“client content” means photographs, images, answers, preferences, measurements, messages, documents or other information that you provide to NUVORA.
“personalised service” means work created, adapted or prepared specifically for you using your photographs, information, preferences or instructions.
“personal information” has the meaning given to it under the Protection of Personal Information Act, 4 of 2013, commonly referred to as POPIA.
2. Nature of the Service
NUVORA provides personalised, non-medical appearance analysis and guidance.
Depending on the product purchased, the service may include:
- Analysis of facial proportions, face shape, visual balance and appearance-related characteristics.
- Hairstyle, hair-colour and facial-hair recommendations.
- Grooming and skincare guidance.
- Makeup recommendations and visual examples.
- Edited images, hairstyle previews or appearance visualisations.
- Personalised reports, checklists and implementation guidance.
- General educational content relating to appearance and presentation.
The exact contents of your purchase are determined by the product description displayed when you place your order.
NUVORA does not guarantee that every feature, recommendation category or visual output will be included in every product.
3. Use of Specialist and AI-Assisted Tools
To improve consistency, efficiency and the quality of its deliverables, NUVORA may use specialist software, analysis systems and AI-assisted production tools.
These tools may support:
- Photograph and image-quality assessment.
- Appearance-related analysis.
- Development and organisation of recommendations.
- Document drafting, formatting and consistency checking.
- Image editing and the creation of visual examples.
- Internal quality-control processes.
These tools form part of NUVORA’s internal production process and are used under NUVORA’s direction. Deliverables may therefore include content or visual elements created with automated or AI-assisted methods.
Automated systems are not infallible. You acknowledge that outputs may contain technical, visual, interpretive or factual errors and must be considered together with your own preferences and judgment.
4. Eligibility
You must be at least 18 years old to purchase or use the service.
You must not submit photographs or personal information relating to a minor.
NUVORA may refuse or cancel an order where it reasonably believes that the service is being purchased for or used in relation to a minor.
5. Orders and Acceptance
Placing an order constitutes an offer to purchase the selected service.
An order is accepted once:
- Payment has been successfully received or authorised;
- NUVORA has confirmed the order; and
- Any photographs, information or other materials required to perform the service have been received in an acceptable form.
NUVORA may refuse or cancel an order where:
- Payment cannot be verified.
- The submitted information is incomplete or unusable.
- The submitted content breaches these Terms.
- The request falls outside the scope of the service.
- The request creates a legal, ethical, security or operational risk.
- An obvious pricing or product-description error occurred.
Where NUVORA cancels an order before work begins, amounts paid for that order will ordinarily be refunded through the original payment method.
6. Pricing and Payment
Prices are displayed on the website or at checkout and are charged in the currency stated at the time of purchase.
You are responsible for reviewing the product description, price and order details before completing payment.
Payments may be processed by third-party payment providers. NUVORA does not ordinarily receive or store your complete card details.
You agree to provide accurate billing information and confirm that you are authorised to use the selected payment method.
NUVORA may correct genuine pricing, description or technical errors. Where an error materially affects an order already placed, you will be given the option to accept the corrected terms or receive a refund.
7. Information and Photographs Required
You must provide the photographs, answers and information reasonably required for NUVORA to perform the service.
You agree that:
- The information you provide will be accurate and complete.
- Photographs will be sufficiently clear and suitable for analysis.
- You will follow any photograph-capture instructions supplied by NUVORA.
- You will disclose whether photographs have been filtered, retouched or materially altered.
- You will respond within a reasonable time where clarification is required.
Photograph quality, lighting, camera angle, lens distortion, facial expression, filters, makeup, hair placement and image compression can affect the analysis and resulting recommendations.
NUVORA is not responsible for reduced accuracy caused by incomplete, misleading or unsuitable information supplied by you.
8. Ownership and Permission to Submit Content
You retain ownership of the client content you submit.
You confirm that:
- You own the content or have lawful permission to submit it.
- Photographs submitted for analysis are photographs of you.
- You will not submit another person’s photograph without that person’s informed and express permission.
- Your submission does not infringe another person’s privacy, intellectual-property or personality rights.
- You will not submit unlawfully obtained, deceptive or manipulated material for harmful purposes.
By submitting client content, you give NUVORA a limited, non-exclusive licence to access, store, process, analyse, reproduce and adapt that content only to the extent reasonably necessary to:
- Perform your order.
- Produce and deliver your personalised outputs.
- Respond to support requests.
- Maintain security and prevent misuse.
- Comply with legal obligations.
- Resolve complaints or disputes.
This licence does not transfer ownership of your photographs to NUVORA.
9. Privacy and Confidentiality of Client Content
NUVORA treats your photographs, answers and personal information as private and confidential.
NUVORA will not, without your separate express permission:
- Publish your photographs.
- Post your photographs on social media.
- use your photographs in advertising.
- Include your photographs in public examples, case studies or portfolios.
- Use your name, likeness or results in a testimonial.
- Sell your photographs or personal information.
- Make your identifiable photographs publicly accessible.
- Use your photographs to train a public AI model.
Your information may be accessed internally only by people who reasonably require access to perform, support, secure or administer the service.
Information may also be disclosed where required by law, court order, regulatory obligation or a legitimate investigation into fraud, abuse or security incidents.
10. Service Providers and Processing Tools
NUVORA may use carefully selected third-party service providers to support the operation and delivery of the service.
These may include providers of:
- Website and ecommerce infrastructure.
- Payment processing.
- Secure hosting and cloud storage.
- Email and customer communications.
- Document creation and file delivery.
- Image-processing and editing tools.
- AI-assisted production tools.
- Analytics, security and fraud prevention.
- Professional legal, accounting or technical services.
These providers may process limited client information only where reasonably necessary to perform their function.
Where required, NUVORA will take reasonable steps to ensure that providers are subject to appropriate confidentiality, security and data-processing obligations.
Some providers may process or store information outside South Africa. Where cross-border processing occurs, NUVORA will take reasonable steps to ensure that it occurs in accordance with applicable data-protection requirements.
Further information about NUVORA’s processing practices must be set out in its Privacy Policy.
11. Facial Images and Sensitive Information
Your photographs may reveal sensitive personal characteristics or information relating to your appearance.
NUVORA processes facial images for appearance-analysis, recommendation and image-editing purposes. They are not intended to be used for surveillance, law-enforcement profiling or identity authentication.
By voluntarily submitting photographs, you consent to their processing for the purposes described in these Terms and the Privacy Policy.
You may withdraw your consent by contacting NUVORA. Withdrawal will not invalidate processing that lawfully occurred before the withdrawal and may prevent NUVORA from completing or continuing the requested service.
12. Information Retention and Deletion
NUVORA will retain client content only for as long as reasonably necessary to:
- Complete and deliver the service.
- Provide reasonable post-delivery support.
- Maintain business and transaction records.
- Resolve disputes or complaints.
- Prevent fraud or misuse.
- Comply with legal obligations.
You may request deletion of your photographs or other personal information by contacting [insert privacy email].
NUVORA will take reasonable steps to delete, destroy, restrict or de-identify information where required by applicable law.
Certain transaction, tax, legal or complaint records may need to be retained after a deletion request. Limited copies may also remain in secure backups until those backups are overwritten in accordance with ordinary retention procedures.
Deleting source photographs may prevent NUVORA from reproducing, revising or re-delivering certain outputs.
13. Privacy Requests
Subject to applicable law, you may request that NUVORA:
- Confirm whether it holds your personal information.
- Provide access to your personal information.
- Correct inaccurate or incomplete information.
- Delete information that is no longer lawfully required.
- Restrict or object to certain processing.
- Withdraw consent where processing depends on consent.
Requests must be sent to [insert privacy email]. NUVORA may require reasonable proof of identity before processing a request.
14. Delivery
Deliverables will be supplied digitally using the email address, download method, customer portal, messaging platform or other delivery channel stated at checkout or agreed with you.
Any delivery date or turnaround time is an estimate unless NUVORA expressly confirms a guaranteed deadline in writing.
Delivery may be delayed where:
- Required photographs or information are missing.
- Submitted photographs do not meet the required standard.
- You do not respond to clarification requests.
- A technical or third-party service interruption occurs.
- The scope of the request changes.
- Events outside NUVORA’s reasonable control occur.
A deliverable is considered delivered when it is sent to the contact information supplied by you or made available through the agreed delivery method.
You are responsible for providing accurate contact details and checking spam, junk and filtered-message folders.
15. Business Operating Hours and Priority Assistance
NUVORA’s normal business operating hours are:
- Monday to Thursday: 09:00 to 16:30.
- Friday: 09:00 to 12:00.
- Saturday and Sunday: Closed.
- South African public holidays: Closed.
All operating hours are stated in South African Standard Time, being SAST (UTC+2).
For purposes of these Terms, a “Business Operating Day” means a Monday, Tuesday, Wednesday, Thursday or Friday on which NUVORA is open for business. Saturdays, Sundays, South African public holidays and any closure dates announced by NUVORA are not Business Operating Days.
Messages, photographs, revision requests, support requests or other communications received outside Business Operating Hours will be treated as having been received when NUVORA next opens for business.
Priority Assistance
Where you purchase Priority Assistance or another priority service:
- Your request will be placed ahead of standard requests in NUVORA’s active production or support queue.
- Priority Assistance applies only during NUVORA’s Business Operating Hours and on Business Operating Days.
- Priority Assistance does not operate during evenings, weekends, South African public holidays or announced business closures.
- A priority request received outside Business Operating Hours will enter the priority queue when NUVORA next opens.
- Priority Assistance does not constitute a 24-hour, after-hours, weekend or emergency-support service.
- Priority Assistance does not guarantee immediate completion, an immediate response or delivery on the same day unless NUVORA has expressly provided a written delivery commitment for that specific order.
- Delivery estimates may be extended where required information or suitable photographs have not been supplied, where clarification is required, or where circumstances outside NUVORA’s reasonable control delay performance.
Any turnaround period stated in Business Operating Days excludes Saturdays, Sundays, South African public holidays and announced closure dates.
16. Revisions and Changes
Any revisions included with a purchase will be described in the applicable product description or order confirmation.
Unless expressly stated otherwise:
- A purchase does not include unlimited revisions.
- Revisions must remain within the original scope of the product.
- A revision is not a complete replacement of the original service direction.
- Requests based on new photographs, changed preferences or new instructions may be treated as additional work.
- Additional or out-of-scope work may require a separate fee.
Requests must be made within [insert number] days after delivery, unless a different period is stated in the product description.
17. Accuracy and Subjectivity of Outputs
Appearance analysis and personal styling involve subjective judgment.
NUVORA does not guarantee that every recommendation will match your personal taste or produce the result you expect.
You acknowledge that:
- Automated and visual analysis may contain errors.
- Different professionals may reasonably make different recommendations.
- Image quality can materially affect results.
- Appearance preferences vary between people, cultures, workplaces and contexts.
- Recommendations may need to be adapted to your lifestyle, budget, hair texture, skin sensitivity or product availability.
- You remain responsible for deciding whether to act on a recommendation.
The service is intended to support your decision-making. It is not a final or infallible authority.
18. Edited Images and Visualisations
NUVORA may provide edited photographs, hairstyle previews, makeup examples, before-and-after concepts or other visual outputs.
These outputs are illustrative and may contain generated or digitally edited elements.
They are not photographs of guaranteed future results.
Actual outcomes may differ because of:
- Hair type, density, texture and growth patterns.
- Skin texture, tone and sensitivity.
- Lighting and camera conditions.
- Product selection and availability.
- Styling skill and professional execution.
- Personal anatomy and biological variation.
- Limitations in image-editing or generation technology.
Visual outputs must not be interpreted as a guarantee that a salon, barber, makeup artist, skincare product or other service will reproduce the displayed result exactly.
19. No Medical or Healthcare Advice
NUVORA does not provide medical, dermatological, psychological, surgical or other healthcare services.
The service does not diagnose, treat, cure, prevent or manage:
- Skin or scalp conditions.
- Hair-loss conditions.
- Allergies or sensitivities.
- Psychological or body-image conditions.
- Any illness, injury or medical condition.
NUVORA does not provide recommendations for surgery, injectables, prescription medication or invasive cosmetic procedures.
General skincare, haircare, makeup or grooming information is provided for informational purposes only.
Consult a suitably qualified healthcare professional before acting where you have a medical condition, persistent symptoms, allergies, sensitivities or other health concerns.
20. No Guaranteed Personal Outcomes
NUVORA does not guarantee that the service will improve or produce any particular:
- Appearance outcome.
- Confidence level.
- Dating or relationship result.
- Employment or career result.
- Social response.
- Financial benefit.
- Professional opportunity.
- Personal transformation.
Marketing images, testimonials, examples and visualisations illustrate possible approaches or individual experiences. They do not guarantee equivalent results for every client.
21. Third-Party Products and Services
NUVORA may mention or recommend third-party products, brands, retailers, salons, barbers, makeup artists, skincare providers or other services.
Unless expressly stated otherwise, NUVORA does not manufacture, supply, control or guarantee those products or services.
You are responsible for checking:
- Product ingredients and allergens.
- Suitability for your skin, hair or circumstances.
- Product availability and current pricing.
- Third-party delivery and return policies.
- Professional qualifications where relevant.
- Instructions, warnings and patch-testing requirements.
NUVORA is not responsible for a third party’s acts, omissions, products, service quality, pricing or availability.
Where NUVORA receives an affiliate fee, referral fee or commercial benefit from a recommendation, this should be disclosed where reasonably required.
22. Cancellations and Refunds
Refunds and cancellations are governed by NUVORA’s Refund Policy and applicable consumer law.
Because NUVORA’s services are personalised and may involve work commencing shortly after receiving your photographs and information, you should contact NUVORA immediately if you wish to cancel an order.
Where permitted by law, a change-of-mind refund may be refused or reduced after:
- Personalised work has begun.
- Analysis has been performed.
- A report or image has been created.
- A deliverable has been supplied or accessed.
- Substantial performance has occurred at your request.
NUVORA may provide an appropriate refund, correction, replacement or other remedy where:
- You were charged incorrectly.
- NUVORA cannot provide the purchased service.
- The wrong product was supplied.
- A deliverable is materially defective or materially inconsistent with the product description.
- Applicable law requires a remedy.
Dissatisfaction based solely on subjective preference does not automatically mean that a deliverable is defective.
Nothing in these Terms excludes a cooling-off right, refund right or consumer remedy that cannot lawfully be excluded.
Refund requests must be sent to [insert support email] and include your name, order number, payment reference and reason for the request.
23. Acceptable Use
You must not use the service to:
- Analyse or edit another person’s image without permission.
- Harass, shame, humiliate, stalk, exploit or impersonate another person.
- Create deceptive, defamatory or non-consensual visual content.
- Submit unlawful, explicit, abusive, hateful or violent content.
- Request medical, surgical or invasive-treatment recommendations.
- Infringe intellectual-property, privacy or personality rights.
- Circumvent payment, security or access controls.
- Introduce malware or harmful code.
- Scrape, reverse engineer or systematically extract NUVORA’s systems or content.
- Resell or commercially exploit the service without written permission.
- Misrepresent a NUVORA deliverable as certified medical or professional healthcare advice.
- Use the service for any unlawful or harmful purpose.
NUVORA may refuse service, remove submitted content or restrict access where this section is breached.
24. Intellectual Property
NUVORA or its licensors own all intellectual property relating to the service, including:
- Brand names, logos and visual identity.
- Website content and design.
- Report layouts and templates.
- Recommendation frameworks and methodologies.
- Written educational material.
- Production workflows and prompts.
- Software, databases and systems.
- Original graphics, examples and marketing content.
You retain ownership of your original client content.
Subject to full payment, NUVORA grants you a limited, non-exclusive licence to use and share your final deliverables for personal, lawful and non-commercial purposes.
You may not, without prior written permission:
- Resell a deliverable.
- Reproduce NUVORA templates for commercial use.
- Remove NUVORA ownership notices from proprietary material.
- Claim NUVORA’s methodology or content as your own.
- Use deliverables to create a competing service.
- Sell, license or commercially distribute NUVORA’s reports or systems.
This clause applies only to the extent that intellectual-property rights can legally be granted or enforced in the relevant content.
25. Testimonials and Marketing Permission
NUVORA will not use your identifiable photographs, results, name, testimonial or personal story in public marketing without your express permission.
Permission for marketing use must be obtained separately from your acceptance of these Terms.
Where you grant permission, the agreed material may be used only within the scope of that permission.
You may withdraw permission for future use by contacting NUVORA. Withdrawal will not necessarily require the recall of material already printed, published or distributed before the request was received, but NUVORA will take reasonable steps to stop future use.
26. Marketing Communications
Where permitted and where any required consent has been obtained, NUVORA may send communications regarding:
- Your order.
- Delivery or support.
- Product updates.
- Educational content.
- Promotions or offers.
You may opt out of non-essential marketing communications using the available unsubscribe method or by contacting NUVORA.
NUVORA may still send messages reasonably necessary to process, deliver or support your order.
27. Website and Service Availability
NUVORA aims to maintain a reliable website and service but does not guarantee uninterrupted or error-free availability.
Access may be affected by:
- Maintenance.
- Hosting or internet failures.
- Payment-provider interruptions.
- Security incidents.
- Software or production-tool failures.
- Third-party outages.
- Events outside NUVORA’s reasonable control.
NUVORA may update, replace, suspend or discontinue website functionality or service components where reasonably necessary.
Where a material interruption prevents completion of a paid order, NUVORA will provide an appropriate remedy in accordance with applicable law.
28. Third-Party Websites
The website or deliverables may contain links to third-party websites or platforms.
Links are provided for convenience and do not necessarily constitute endorsement.
NUVORA does not control and is not responsible for third-party content, privacy practices, availability, security or terms.
You access third-party services at your own discretion.
29. Disclaimer of Warranties
To the maximum extent permitted by law, the service and website are provided on an “as available” basis.
NUVORA does not warrant that:
- Every analysis or recommendation will be accurate or complete.
- Every visualisation will precisely preserve all facial details.
- Every recommendation will suit your taste.
- The website will always be available.
- Digital files will be compatible with every device or application.
- Third-party products or services will achieve a specific outcome.
This section does not exclude any warranty, right or remedy that cannot legally be excluded.
30. Limitation of Liability
To the maximum extent permitted by applicable law, NUVORA will not be liable for indirect, incidental, special or consequential losses arising from the use of the service.
This may include loss arising from:
- Reliance on a recommendation or visual output.
- Subjective dissatisfaction with a deliverable.
- Decisions relating to hair, grooming, makeup, skincare, clothing or personal presentation.
- The acts or omissions of third-party providers.
- Loss caused by inaccurate information supplied by you.
- Your unauthorised sharing or misuse of a deliverable.
- Temporary website or service interruption.
Where NUVORA is legally liable and that liability may lawfully be limited, its aggregate liability relating to a particular order will not exceed the amount paid by you for that order.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any other liability that cannot legally be excluded or limited.
31. Indemnity
To the extent permitted by law, you agree to compensate NUVORA for direct losses, liabilities, claims and reasonable costs caused by:
- Your unlawful use of the service.
- Your material breach of these Terms.
- Your submission of another person’s content without permission.
- Your infringement of another person’s intellectual-property, privacy or personality rights.
- Fraudulent or deliberately misleading information supplied by you.
- Your commercial resale or unauthorised reproduction of NUVORA content.
This clause does not require you to compensate NUVORA for loss caused by NUVORA’s own unlawful conduct, gross negligence or breach of these Terms.
32. Refusal or Termination of Service
NUVORA may refuse, suspend or terminate service where:
- You materially breach these Terms.
- You submit prohibited or unlawful content.
- You fail to provide required information.
- You attempt to misuse or compromise NUVORA’s systems.
- You infringe another person’s rights.
- NUVORA is legally required to do so.
- Continuing the service creates a material legal, security or safety risk.
Where service is ended because of your material breach after work has begun, any refund will be determined according to the work already performed, losses reasonably incurred and applicable law.
33. Changes to the Service
NUVORA may update its products, processes, pricing, tools, product descriptions and website from time to time.
Changes will not retrospectively reduce the material contents of an order already accepted unless:
- You agree to the change;
- The change is reasonably necessary to complete the service; or
- The original service can no longer lawfully or technically be provided.
Where a material adverse change affects an accepted order, NUVORA will offer a reasonable alternative or an appropriate refund.
34. Changes to These Terms
NUVORA may update these Terms where necessary to reflect changes in its services, operations, technology or legal obligations.
The latest version will be published on the website together with its effective date.
The version accepted when you place an order will ordinarily govern that order, unless a change is required by law or you expressly agree to an updated version.
35. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Mandatory consumer or privacy protections that apply to you remain unaffected.
36. Complaints and Dispute Resolution
You must first submit any complaint to:
Email: [Insert complaints or support email]
Your complaint should include your name, order number, relevant dates and a clear description of the issue.
NUVORA will be given a reasonable opportunity to investigate and attempt to resolve the complaint.
Where a dispute cannot be resolved informally, either party may use any applicable mediation, alternative dispute-resolution, consumer-protection or court process.
Nothing in these Terms prevents you from approaching a competent regulator, ombud, consumer authority or court where you are legally entitled to do so.
37. Consumer Rights
Nothing in these Terms is intended to waive, exclude or restrict a right or remedy that cannot lawfully be waived, excluded or restricted.
If any provision conflicts with mandatory consumer-protection law, the mandatory legal provision will apply.
38. Electronic Communications
You agree that:
- Agreements may be concluded electronically.
- Selecting an acceptance checkbox or completing an order may constitute acceptance.
- Notices and deliverables may be sent electronically.
- Electronic communications and records may be retained as evidence of transactions.
- You are responsible for keeping your contact information accurate.
39. General Provisions
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
A failure by NUVORA to enforce a provision does not constitute a permanent waiver of that provision.
These Terms, together with the applicable product description, order confirmation, Privacy Policy and Refund Policy, form the agreement between you and NUVORA regarding the purchased service.
You may not transfer your rights or obligations under these Terms without NUVORA’s written permission.
NUVORA may transfer its rights and obligations as part of a lawful restructuring, sale or transfer of the business, subject to applicable privacy and consumer-protection requirements.
